MOCK TRIALS OR FOCUS GROUPS

We tend to use these two phrases interchangeably, but what we are really talking about is previewing your case to a group of typical jurors, before the case actually goes to trial.  We have a database of several hundred participants in San Diego, who are paid to hear a distillation of the case from both sides and often from witnesses. They are given instructions and actually "deliberate" the case as if they were real jurors.  This is how we learn the strengths and weaknesses of a real case before it  goes to trial, when jurors perceive the the "problems," and we can better "refocus" the case for  trial.  Mock jurors have an uncanny way of spotting the same issues that trouble real jurors and this gives our side the advantage in dealing with how to present these "hinge" issues.  Focus groups also frequently come up with superior themes based on their everyday  common sense experiences, and greatly assist in our ability to profile the best case and worst case jurors for clients.  We provide highly qualified, experienced, and thoughtful feedback and analysis following focus group deliberations as needed, which may include a written report.

An analysis of best jurors for the type of case being tried, and more importantly, the types of jurors to watch out for and eliminate from the jury pool. Remember it is really  a "de-selection"  process.

Written Jury Questionnaires

...Are usually used in long cases with lots of "Hot Button" issues - which are commonly areas many prospective jurors would be reluctant to divulge in open court.  Examples include: Strong ethnic bias, sexual assault, problems with substance abuse, employment issues, etc. Written questionnaires are also useful in lengthy cases where there are many complex issues and a large jury pool.

WITNESS PREPARATION

Often critical and many times overlooked by attorneys and their clients who believe simply telling the truth is good enough. Our experience indicates that the witnesses who do best are not simply telling the truth , but are PERCEIVED by jurors as truthful, real, honest and authentic. Perception is reality and many witnesses are so nervous and defensive that they are out of character when they testify.  Preparing witnesses also includes preparation for the many pitfalls of testifying, the appropriate demeanor, dress, style and emotional attitude for "optimum perception" in deposition and trial.

IN COURT ASSISTANCE IN JURY SELECTION

We all see things just a little differently, based on our past experiences and perceptions.  it is very helpful to a case to have an experienced Jury Consultant present during the selection process.  Often the selection itself moves so quickly that just keeping track of prospective jurors is a real challenge.  While the final choice to remove a juror rests with lead trial counsel, having an extra set of eyes and ears goes a long way in making decisions in a highly charged environment under rapid time and pressure constraints.

DEBRIEFING JURORS POST VERDICT

We will interview and debrief jurors following a verdict, to look for any possible juror misconduct in deliberation, or  the lack of juror misconduct.
